Additional Sessions Judge of Karkardooma Courts, Amitabh Rawat, has framed charges against Shahrukh Pathan and four others in FIR No. 49/2020. Notably, the court has discharged them of the offenses under Arms Act.
Shahrukh Pathan and four other accused identified as Salman S/o Sabir Ali, Gulfam S/o Sarif, Aatir S/o Shakil Ahmed and Osama S/o Shakil Ahmed have been charged Sections 307 (attempt to murder), 147 (rioting), 148 (rioting armed with weapon), 149 (unlawful assembly), 186 (obstructing public servant in discharge of public functions), 188 (disobedience to order duly promulgated by public servant), 153A of IPC.
Commenting on dropping of charges under the Arms Act, Advocate Khalid Akhtar said that this is just an “appeasement”. He believes that the entire case against Pathan is fake and fabricated in view of various “facts” including contradictory claims made by witnesses and police personnel about Pathan.
In September this year, Akhtar had filed a 244-page discharge petition in the court of Mr Rawat. In the plea, Akhtar had urged the court to discharge Shahrukh Pathan from all offenses levelled in FIR 49/2020.
