In a case of communal riots that broke out in north-east Delhi last year, the court has instructed the police to make audio and video recordings during interrogation of the accused. At the same time, the court has also given great relief to the accused. The court has, however, stayed the arrest of the accused.
The court of Additional Sessions Judge Vinod Yadav in Karkardooma Court has stayed the arrest of this accused in the case related to the Delhi riots till June 19. Also, the hearing of the case has also been postponed till the next date. An anticipatory bail petition was filed in the court on behalf of the accused in the case. Police said that the accused was absconding for a long time and non-bailable warrants are also issued against him. At this, the court asked the investigating officer whether the accused was given notice under Section 41 of CrPC. To this, the police replied that they had issued a notice under Section 160 of the CrPC to join the investigation, while the accused said that he had not received any notice. At this, the court directed the accused to be involved in police interrogation.
The court also asked the police to give written notice to the accused for involvement in the interrogation. The copy of this notice should be kept on record so that the accused cannot make such a claim again that he was not called for questioning. Also, the court said that the audio-video recording of the accused should be called for questioning as often as possible and whoever questions and answers to it. This recording should be kept on record along with the case file of the case. It is known that the accused had not yet been arrested in this case.
