The Delhi High Court on Tuesday (October 29, 2024) dismissed the Public Interest Litigation (PIL) seeking directions to the authorities concerned to allow admissions of children of Rohingya refugees in local schools.
he PIL, filed by Social Jurist, an NGO, argues that the refusal of school admissions to the refugee children violates their fundamental right to education as outlined in the Indian Constitution and the Right to Education Act, 2009.
The petitioner also contended that the Delhi government and the MCD were not allowing admissions to these Rohinya children from Myanmar as they didn’t had Aadhar card but all of them were living in Khajoori Chowk area.
The Bench of Chief Justice Manmohan and Justice Tushar Rao Gedela dismissed the PIL and said that the court will not get involved in this matter. The bench further suggested the Union Ministry of Home Affairs could instead be approached on this issue.
Explaining that there are international implications involved in the matter as the children mentioned in the PIL are not Indian’s the court noted that this matter required a policy decision which can be taken by the government of India.
