NEW DELHI—The Delhi High Court on April 8 this year granted protection to the 40-year-old Faizyab Masjid and Madrasa in Sarai Kale Khan that faced demolition by the Delhi Development authority and the Delhi Religious Committee.
The protection was granted on a petition filed by the mosque caretaker Deen Mohammed through his advocate Fuzail Ayubi.
The single judge bench of Justice Sachin Datta had issued notices to the DDA and the Delhi Religious Committee, directing the DDA to file a status report on the property within a week. The court’s intervention then provided temporary relief to the mosque, prohibiting any harm to the structures until the next hearing scheduled for May 8. However, the matter was subsequently postponed to September 12, 2024.
But in a surprising turn of events, the caretaker has now withdrawn his petition from the Delhi High Court and also sought to get vacated both religious premises within one month, potentially allowing the demolition by the DDA and a local Delhi civic body.
Accordingly, a vacation bench comprising Justice Amit Sharma on May 12 granted one month’s time, dismissing the petitions.
The court’s ruling came after Deen Mohammad, the caretaker of the mosque, pledged in court through his counsel, Advocate Kamlesh Kumar Mishra, to vacate the premises within one month.
The bench acknowledged Deen Mohammad’s commitment, specifying that no further extensions would be granted.
