
A sessions court on Tuesday stayed the order of a magistrate court to lodge an FIR against a police official for allegedly assaulting and forcing five Muslim men to sing the national anthem during the 2020 north-east Delhi riots. One of them, Faizan, later died.
Additional Sessions Judge Sameer Bajpai of Karkardooma Court on February 1 was hearing a revision petition filed by Shailendra Tomar, the then station house officer of Jyoti Nagar police station, against the order by Judicial Magistrate First Class Udbhav Kumar Jain, who had on January 18 termed the police’s action as “hate crime”. The revision plea argued that the lower court was not competent to order the registration of FIR when the same allegations are already sub-judice before the Delhi High Court.
