NEW DELHI: A Delhi court has dismissed the Police’s application to withdraw three complaints consolidated in a case related to the 2020 North East Delhi riots.
Additional Sessions Judge Pulastya Pramachala, presiding over a case involving 11 accused registered by the Dayalpur police station in connection with the communal riots, stated that any plea conflicting with the final report in a case based on charge sheets is not tenable.
In an order issued on Saturday, the judge considered the arguments presented by the Special Public Prosecutor (SPP) on the Investigating Officer’s (IO) application to withdraw three complaints included in the case.
The court sought the SPP’s opinion on the application’s maintainability, to which the SPP responded that an order could be issued in accordance with the law.
“In my opinion, when the prosecution is based upon the charge sheet and supplementary charge sheet, any application taking a stand contrary to the stand taken by prosecution in the charge sheets cannot be maintainable,” the court remarked.
